Attorney Powers was successful in a motion to suppress, arguing that the police officer who made the  automobile stop could not have  made the claimed observations. After an evidentiary hearing, the motion judge agreed, specifically finding that the officer’s testimony about his observations was not credible. The court then suppress the stop and all evidence as to  contraband found in the car. Accordingly the Commonwealth  dismissed the case.Attorney Powers was successful in a motion to suppress, arguing that the police officer who made the  automobile stop could not have  made the claimed observations
