Family Court Decision - 2014-2017

Attorney Powers was trial counsel in Sturtevant v. Emery, Mass Appeals Ct. (2017).  At the trial, a husband was seeking a downward modification of both his child support and alimony obligations due to a job loss.

Attorney Powers was trial counsel in Sturtevant v. Emery, Mass Appeals Ct. (2017). At a trial Husband was seeking a downward modification of both his child support and alimony obligations due to a job loss. The wife claimed that the husband should have income imputed because his behavior caused his job loss. The husband argued, and the evidence showed that he and taken extraordinary steps to obtain comparable employment and taken the first job offered. On appeal, the trial strategy was affirmed with a large reduction in support being ordered.
